(Dec. 5, 2024) \u2014 Today, the Michigan Senate passed legislation sponsored by Senate Majority Floor Leader <b>Sam Singh<\/b> (D-East Lansing) that would bolster protections for Michigan consumers by restoring power to the Michigan Consumer Protection Act, <span data-ogsc=\"rgb(5, 99, 193)\"><u><a href=\"https:\/\/senatedems.com\/bayer\/2024\/10\/09\/consumer-protections\/\" id=\"OWA635c19d1-f1eb-b672-3475-7845afc1c560\" class=\"x_Hyperlink x_SCXW57605144 x_BCX8 x_OWAAutoLink\" data-auth=\"NotApplicable\" data-ogsc=\"rgb(5, 99, 193)\" title=\"https:\/\/senatedems.com\/bayer\/2024\/10\/09\/consumer-protections\/\" data-outlook-id=\"ced3828a-543b-49c3-bb08-11abb67b87da\">building on additional efforts<\/a><\/u><\/span> by Senate Democrats to strengthen consumer protections in the state. \u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">The once-powerful act \u2014 gutted following a 1999\u00a0Michigan Supreme Court ruling \u2014 condones deceptive, fraudulent activity of individuals and businesses so long as they act within a profession that is government-regulated.\u00a0Now headed to the House for consideration, <span data-ogsc=\"rgb(5, 99, 193)\"><u><a href=\"https:\/\/www.legislature.mi.gov\/Bills\/Bill?ObjectName=2024-SB-1022\" id=\"OWAe159b2a0-db65-2b75-803a-6a3c80491926\" class=\"x_Hyperlink x_SCXW57605144 x_BCX8 x_OWAAutoLink\" data-auth=\"NotApplicable\" data-ogsc=\"rgb(5, 99, 193)\" title=\"https:\/\/www.legislature.mi.gov\/Bills\/Bill?ObjectName=2024-SB-1022\" data-outlook-id=\"5f326470-3844-4255-b347-766e6fbe04ae\">Senate Bill 1022<\/a><\/u><\/span> would remove those exemptions as well as equip the Michigan Dept. of Attorney General with the authority to investigate, ensuring bad actors and harmful business practices can be held accountable under state law.\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u201cWhether they\u2019re shopping at the grocery store, picking up much-needed medication, or working with a contractor to remodel their home, Michiganders shouldn\u2019t have to worry about being harmed or taken advantage of as they go about their business. Yet unfortunately, for far too long now, residents in every part of Michigan have suffered the impacts from living in what is now known as the worst state in the country for consumer protection laws,\u201d said Sen. <b>Singh<\/b>. \u201cThis legislation would restore the power once held in our Consumer Protection Act \u2014 bringing us in line with most other states \u2014 and ensure that bad actors are held accountable. It\u2019s time we get this done \u2014 our residents are counting on us.\u201d\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">On top of restoring robust consumer protection efforts to the state Attorney General\u2019s office, Senate Bill 1022 would also create a new fund to support enforcement and education efforts to assist residents and reduce scams. And, following consumer protection best practices, this legislation would create increased penalties for violations against elderly and vulnerable adults.\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">This legislation is a response to the Michigan Supreme Court 1999 case decision in <i>Smith v. Globe Life Insurance Company<\/i>, which weakened the power of the Michigan Consumer Protection Act by exempting many industries from liability, leaving residents ill-protected from scams and other deceptive activity.\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\">\u00a0<\/div>\n<div data-ogsc=\"rgb(0, 0, 0)\" style=\"text-align: center;\">###<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senate Bill 1022 would restore power to MI Consumer Protection Act, Office of Attorney General\u00a0 \u00a0 LANSING, Mich.
