LANSING, Mich. (<\/span>March\u00a0<\/span><\/span>3<\/span>, 2023) \u2014<\/span>\u00a0<\/span>Earlier this week, Senate and House members introduced bipartisan legislation that abolishes juvenile life without parole (JLWOP) in Michigan to align our state with\u00a0<\/span><\/span><\/span>26 other states<\/span><\/span><\/a>\u00a0that have taken steps to comply with the U.S. Supreme Court ruling,\u00a0<\/span><\/span><\/span>Miller v. Alabama<\/span><\/span><\/a>,\u00a0<\/span><\/span>that declared automatically sentencing a child to life without parole was unconstitutional. Additionally, these bills comply with recent Michigan Supreme Court\u00a0<\/span><\/span><\/span>decisions<\/span><\/span><\/a>\u00a0by eliminating mandatory life without parole sentences for 18-year-olds and requiring consideration of age, immaturity, and the other factors outlined in\u00a0<\/span><\/span><\/span>Miller<\/span><\/span>.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span>\u00a0<\/span>
<\/span><\/p>\n

\u201cThe United States Supreme Court and the Michigan Supreme Court have ruled that automatically sentencing youth to life without parole is cruel and unusual punishment. Michigan law needs to recognize that juvenile offenders deserve a chance at rehabilitation,\u201d\u202f<\/span>said\u00a0<\/span><\/span>Sen.<\/span><\/span>\u00a0<\/span>Jeff\u00a0<\/span><\/span>Irwin<\/span><\/span>\u202f<\/span>(D-Ann Arbor)<\/span>. \u201cWe shouldn\u2019t turn our backs on juvenile offenders and throw away the key. Instead, we should ensure that Michigan\u2019s juvenile justice system provides a chance for rehabilitation, reintegration, and redemption.\u201d<\/span><\/span>\u00a0<\/span>

Together, Senate Bills\u00a0<\/span><\/span><\/span>119<\/span><\/span><\/a>\u2013<\/span><\/span>123<\/span><\/span><\/a>\u00a0and House Bills\u00a0<\/span><\/span><\/span>4160<\/span><\/span><\/a>\u2013<\/span><\/span>4164<\/span><\/span><\/a>\u00a0eliminate life without the possibility of parole for youth under\u00a0<\/span><\/span>19<\/span>, provide a minimum sentence of no less than\u00a0<\/span><\/span>10<\/span>\u00a0years and a maximum sentence of no more than\u00a0<\/span><\/span>60<\/span>\u00a0<\/span>years, and<\/span>\u00a0allow for parole review after\u00a0<\/span><\/span>10<\/span>\u00a0years where incapacities of youth must be considered. \u201cIncapacities of youth\u201d are shorthand for the Miller factors: the juvenile\u2019s age and immaturity; family home environment; circumstances of the offense, including the role the juvenile had in the offense, and any influence of peer pressure.\u00a0<\/span><\/span>\u00a0<\/span>
<\/span><\/p>\n

<\/span>\u00a0<\/span>
<\/span><\/p>\n

\u201cThe law clearly distinguishes children from adults\u2014this is why ending juvenile life without parole is necessary. These are\u00a0<\/span><\/span>kids\u2019<\/span><\/span>\u00a0lives we are talking about. I can\u2019t stress the importance of this legislation enough: It\u2019s the difference between life behind bars and the opportunity for redemption, grace and mercy<\/span>,<\/span>\u201d\u00a0<\/span><\/span>Rep.<\/span><\/span>\u00a0<\/span>Amos\u00a0<\/span><\/span>O\u2019Neal<\/span><\/span>\u00a0<\/span>(D-Saginaw)\u00a0<\/span><\/span>said<\/span>.<\/span>\u00a0\u201cThe state should provide the necessary help, resources, and training for these young people to re-enter society. We must move from a punitive-focused corrections system to one centered around restorative justice.\u201d\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

Scientific\u00a0<\/span><\/span><\/span>research<\/span><\/span><\/a>\u00a0shows that there are key developmental differences between youth and adults that impact youth\u2019s decision-making, impulse control, and susceptibility to peer pressure. These differences do not excuse youth from accountability for their actions, but the U.S. Supreme Court and the Michigan Supreme Court have repeatedly recognized that because of these differences, youth are less blameworthy than adults and more capable of change and rehabilitation.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

\u201cThe Supreme Court has made clear that life without parole sentences for young people should be rare.\u201d Sen.\u00a0<\/span><\/span><\/span>Sylvia\u00a0<\/span><\/span>Santana<\/span><\/span>\u00a0<\/span>(D-Detroit)\u00a0<\/span><\/span>said<\/span>.<\/span>\u00a0\u201cThe Michigan Supreme Court has placed the burden on the prosecuting attorney to prove by clear and convincing evidence that a young person is one of the rare people who should receive a life without parole sentence.\u201d\u00a0\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

Eliminating juvenile life without parole does not allow for the release of offenders prior to their maximum sentence. Rather, it would provide an opportunity for review by the Parole Board after a reasonable period of incarceration, one that takes into consideration the unique circumstances of each defendant<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

\u201cThis legislation gives us the opportunity to rectify this at the state level. Our understanding of effective criminal justice policies has changed over time, and\u00a0<\/span><\/span>so too<\/span>\u00a0should our laws,\u201d said\u00a0<\/span><\/span>Rep.<\/span><\/span>\u00a0Curtis<\/span>\u00a0<\/span>VanderWall<\/span>\u00a0<\/span><\/span>(R-Ludington)<\/span>. \u201cThere are people in Michigan prisons who were sentenced as children to life without parole, and their cases need to be reviewed and given another look.\u201d\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

A\u00a0<\/span><\/span><\/span>study<\/span><\/span><\/a>\u00a0of the Philadelphia District Attorney Office\u2019s\u00a0<\/span><\/span>resentencing<\/span>\u00a0of juvenile lifers found a recidivism rate of just 1.14<\/span>\u00a0percent<\/span>\u00a0among 174 former juvenile lifers.<\/span><\/span>\u00a0<\/span><\/p>\n

\u00a0<\/span><\/p>\n<\/div>\n

\n

\u201cAs the Supreme Court has recognized, children are \u2018constitutionally different than adults for purposes of sentencing\u2019 because they have less culpability than adults\u2014a conclusion that is supported by both social science and brain science documented in Supreme Court decisions,\u201d said\u00a0<\/span><\/span>Safe & Just Michigan Executive Director<\/span><\/span>\u00a0John S. Cooper<\/span><\/span>. \u201cThis package of bills supported by Safe & Just Michigan positions our state to join 26 other states and D.C. in ending the cruel and unusual practice of sentencing children to die in prison.\u201d<\/span><\/span><\/p>\n

\n

Ronnie Waters<\/span><\/span>, a Safe & Just Michigan community engagement specialist who was sentenced to life without parole as a juvenile but released in 2020 after a resentencing hearing, stressed the importance of this package. \u201cThere is a misconception that Miller v. Alabama ended juvenile life without parole for good, but it did not,\u201d he said. \u201cStates like Michigan can still sentence children to death by incarceration.\u201d<\/span><\/span><\/p>\n

These bills<\/span>\u00a0have the support of the Michigan Center for Youth Justice, Safe & Just Michigan, the Campaign for the Fair Sentencing of Youth, and the Michigan State Appellate Defender Office.<\/span><\/span><\/p>\n
