(<\/span>March 2<\/span>, 2023) \u2014\u00a0<\/span><\/span><\/span>Sen<\/span>.<\/span>\u00a0<\/span><\/span>Jeff Irwin\u00a0<\/span><\/span><\/span>(D-Ann Arbor) and\u00a0<\/span><\/span>Sen.\u00a0<\/span><\/span><\/span>John\u00a0<\/span><\/span>Damoose<\/span>\u00a0<\/span><\/span>(R-Harbor Springs) today introduced legislation to<\/span>\u00a0ensure Native American children can benefit from guardianship assistance on an equal basis, and to support more children being permanently placed with guardians<\/span>\u00a0instead of temporary foster care<\/span>.<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

The Guardianship Assistance Program<\/span>\u00a0(GAP)<\/span>\u00a0provides financial support for families who provide permanent guardianship for children when adoption or family reunification are not appropriate options.\u00a0<\/span><\/span>Senate Bill<\/span>s 137<\/span>\u00a0and<\/span>\u00a0138<\/span>\u00a0<\/span>would make Michigan families eligible for the Guardianship Assistance Program without regard to which court orders a child\u2019s guardianship.\u00a0<\/span><\/span>Curr<\/span>ently, c<\/span>hildren with guardianship orders from tribal courts<\/span>\u00a0or out<\/span>–<\/span>of<\/span>-s<\/span>tate courts\u00a0<\/span><\/span>do not qualify for\u00a0<\/span><\/span>this\u00a0<\/span><\/span>assistance.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

\u201cThese bills will fix a fundamentally unfair\u00a0<\/span><\/span>situation in which the state can provide support for a child to be placed in foster care with\u00a0<\/span><\/span>strangers, but<\/span>\u00a0<\/span>cannot provide\u00a0<\/span><\/span>that same amount<\/span>\u00a0<\/span>to\u00a0<\/span><\/span>a guardian within their own\u00a0<\/span><\/span>community or extended family<\/span>,<\/span>\u201d Sen\u00a0<\/span><\/span><\/span>Irwin<\/span><\/span>\u00a0said.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u201c<\/span>I\u2019m glad to\u00a0<\/span><\/span>sponsor this legislation to\u00a0<\/span><\/span>align policy with what matters: the best interests of\u00a0<\/span><\/span>children, not jurisdictional technicalities,\u201d Sen\u00a0<\/span><\/span>Damoose<\/b><\/span>\u00a0said.<\/span><\/span>\u00a0<\/span><\/p>\n

\u201cWe know of at least 10 Sault Tribe families and many other Native families from around the state who have been impacted by the current laws on Guardianship Assistance Program benefits because their cases involve a tribal rather than a state court,\u201d said\u00a0<\/span><\/span><\/span>Austin Lowes<\/span><\/span>, Chairman of the Sault Tribe of Chippewa Indians<\/span>.<\/span>\u00a0<\/span>\u201cWhen this happens, children have to remain in unfamiliar foster homes rather than in the home of a close relative, and those foster families may not uphold tribal cultures or customs.\u201d<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

The United Tribes of Michigan<\/span>,\u00a0<\/span><\/span>which<\/span>\u00a0works on\u00a0<\/span><\/span>behalf of Michigan\u2019s federally recognized tribes, supports the bills.\u00a0<\/span><\/span>\u201cGuardianship is greatly needed, as it most closely resembles and honors our traditional practices, while ensuring legal protections for our children<\/span>,\u201d said\u00a0<\/span><\/span><\/span>Jamie Stuck<\/span><\/span>, President of the United Tribes of Michigan.<\/span>\u00a0<\/span>\u201c<\/span>This amended language, which would allow for all of the 12 federally recognized Tribal Courts in Michigan to be eligible to access the Guardianship Assistance Program (GAP) funds, will serve all of Michigan\u2019s children today, as well as our Next Seven Generations.\u201d\u00a0\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

Stuck continued,<\/span>\u00a0\u201cThe Tribes and the\u00a0<\/span><\/span>s<\/span>tate have recognized each other\u2019s sovereign status by the implementation of conforming laws for the protection of minors, such as the Michigan Indian Child Welfare Protection Act. The GAP amendments continue this laudable process of mutual recognition of tribal protection court orders and state guardianship processes to offer seamless protection of children across jurisdictional borders of the Tribe and the State, while at the same time, recognizing the legitimate independent interests of each tribal sovereign and the state.<\/span>\u201d<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\u00a0<\/span><\/span><\/p>\n

Whitney Gravelle,<\/span><\/span>\u00a0President of the Bay Mills Indian Community, also expressed support for the bills.<\/span>\u00a0<\/span>\u201cBay Mills Indian Community fully approves the amendments to the Guardianship Assistance Program as a means to provide support and equity to tribal families and children<\/span>,\u201d Gravelle said.<\/span>\u00a0<\/span>\u201c<\/span>Over the last several decades at Bay Mills, we have had multiple children who have not been able to participate in the Guardianship Assistance Program but desire guardianships to preserve the established familial relationship with their parents. By enacting this language, both the State of Michigan and Tribal Nations\u00a0<\/span><\/span>will strengthen services provided in guardianships so that we can better serve our children and our families across the Great Lakes.\u201d\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

Whether or not a prospective guardian is eligible for guardianship assistance does not have any legal effect on a court\u2019s guardianship order. However, as a practical matter many families cannot afford to step into the guardianship role without the assistance payments<\/span>, and so the children\u00a0<\/span><\/span>are often placed in foster care instead.\u00a0<\/span><\/span>Because g<\/span>uardianship assistance amounts are pegged to foster care rat<\/span>es<\/span>,<\/span>\u00a0<\/span>m<\/span>aking more\u00a0<\/span><\/span>prospective guardians eligible for guardianship assistance\u00a0<\/span><\/span>will not have a large fiscal impact<\/span>.<\/span>\u00a0<\/span>Guardianship, as a permanent option that often takes place within the child\u2019s extended family, usually provides a more secure placement that keeps children better connected to their communities.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n
