(March 17, 2021) \u2014 Sen.\u00a0<strong>Winnie Brinks<\/strong>\u00a0(D-Grand Rapids) and Rep.\u00a0<strong>Thomas Albert<\/strong>\u00a0(R-Lowell) have introduced legislation to improve the safety measures of Michigan\u2019s various carnivals and amusement park attractions.<br \/><br \/><a rel=\"noreferrer noopener\" href=\"http:\/\/legislature.mi.gov\/doc.aspx?2021-SB-0253\" target=\"_blank\">Senate Bill 253<\/a>\u00a0and\u00a0<a rel=\"noreferrer noopener\" href=\"http:\/\/legislature.mi.gov\/doc.aspx?2021-HB-4527\" target=\"_blank\">House Bill 4527<\/a>\u00a0would increase requirements carnival and amusement park operators would need to meet to secure permits for safe operation, with a possible $2,500 fine each day a mechanical, structural, or electrical defect is detected and not addressed.<br \/><br \/>The legislation was developed\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.michiganradio.org\/post\/tragic-go-kart-accident-leads-push-stricter-amusement-park-regulations\" target=\"_blank\">in response to the tragic story of Rachel Gibbs<\/a>, who in August 2015, went to AJ\u2019s Family Fun Center in West Michigan with her family and needed medical intervention after the scarf she wore got caught in a go-kart&#8217;s wheels and snapped her windpipe. She was not adequately warned about the danger her scarf posed, and staff were also not adequately prepared to treat such a medical emergency after it happened.<br \/><br \/>\u201cRachel\u2019s story is a tragic one, yet something that we in the legislature are very capable of ensuring happens to no one else,\u201d Sen. Brinks said. \u201cAfter many discussions with the family, the Department of Licensing and Regulatory Affairs, and other stakeholders, it is my hope this legislation will not only bring some peace to Rachel\u2019s family, but also equip LARA with the tools it needs to enforce rules and regulations.\u201d<br \/><br \/>Among other provisions that would be enforced by this legislation are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Expanding definitions for an owner and issues regarding serious injury.<\/li><li>Setting requirements for owners to meet in order to obtain a permit from LARA.<\/li><li>Requiring an operator to provide a copy of the manufacturer\u2019s operating instructions and any other bulletins pertaining to the safety, operation, or maintenance of the ride.<\/li><li>Requiring the maintenance of records of training for each employee who is authorized to operate the ride.<\/li><li>Requiring the maintenance records of employee training on emergency response procedures.<\/li><\/ul>\n\n\n\n<p>\u201cThese are important reforms we\u2019ve been working on for years with great help and assistance from Rachel\u2019s family. It became quite clear the state of Michigan could be doing more to keep people safe on carnival rides,\u201d said Rep. Albert. \u201cThis legislation makes customer safety the unquestioned top priority, and emphasizes staff training.
